Environmental Legislation

In developed countries, it is common to find Environmental Legislation in place in order to oblige individuals and businesses to play a central role in the management and protection of the natural environment. Australia is no different. And if you are actively involved in the construction industry, whether as a contractor, worker or business owner, then understanding such legislation and applying it is vital if you wish to avoid financial penalties or prosecution for non-compliance.

In Australia, the environment is legally managed at both the federal and state level. At the Commonwealth level, the main piece of Environmental Legislation is what is known as the Environment Protection and Biodiversity Conservation Act 1999 and is administered by the Department of the Environment, Water, Heritage and the Arts. Below that, each state and territory has their own legislation and apply more specially to certain business activities such as construction and the awarding of licences and permits for jobs. It would wise to take a look at environmental legislation in your state or territory.

One of the most common features of any piece of Environmental Legislation is the necessity to undertake an Environmental Impact Assessment before any project can commence. The reason for this is so that everything possible can be done to reduce the impact of the project on the surrounding environment. It also fulfils humanity’s obligation and responsibility to protect the environment so that future generations can also profit from it. The best and most common way to undertake this assessment in the construction industry is through the development of a Construction Environmental Management Plan.

Environmental Legislation is one of those things that are often overlooked yet increasingly important today for business success.
